SMITH-William C. MICHAEL J. PHELAN Services for Michael J. Phelan, 3. of 4836 Gladys a retired policeman who Wednesday In his home, will be held at 11:30 a.

m. Saturday in Resurrection church. Burial will be in Queen of Heaven cemetery. Mr. Phelan entered the police department in 1915 and was assigned to the detective bureau in 1920.

He served there several years as head of the cartage detail, until he retired in June, 1948. Mr. Phelan, who worked on some of the most important police cases, won four extra compensations and 16 creditable mentions. Surviving are his widow, Mary; a daughter, Mrs. Margaret Roberson; five sons, James Michael Patrick John and Harry ten grandchildren; four sisters, and two brothers.

MRS. MARY BURSON Services for Mrs. Mary Burson, 68, of 914-B Grain Evanston, who died Wednesday in her home, will be held at 9 a. m. Saturday in St.

Mary's Catholic church, Litchfield. Montgomery county. Mrs. Burson. a former publisher of the Litchfield News-Herald, took the paper over after the death in 1924 of her husband, Elbert E.

Burson, who founded it in 1913. She made her home in Decatur, Macon county, from 1838 to 1942 and then moved to Evanston, where she lived with her son, Marion, night "city editor of the Chicago bureau of the Associated Press. A sister. Mrs. W.

of Litchfield, also survives. FREDERICK H. BRAMMER Services for Frederick H. 89, of 831 Judson Evanston. a Chicago attorney for 60 years with offices at 155 N.

Clark will be held at 10:30 a. m. today in his home. Burial will be in Rosehiil cemetery. Mr.

Bram mer died Tuesday in St. Francis hospital, Evanston. At one time hie was real estate expert for the city of Chicago. He had lived in Evanston since 1890 and was Instrumental in organizing the Evanston Unitarian church and was one of the founders of the Parent-Teacher association in Evanston. Surviving are three daughters.

Mrs. Wendell S. Loomis of Houston, Mrs. Bertram A. Weber of Highland Park, and Mrs.

Wi.l- flnfl Mrs. RirhawlT Path Reversal by the Illinois Supreme court of the 22 year sentence imposed on Howard Lang, 14, for the slaying of a 7 year old playmate, Lonnie Fellick, will compel Illinois courts to adopt new procedures In dealing with child slayers, Judge Daniel A.

Roberts, the trial judge, said yesterday. "The Supreme court in the Lang case has firmly fixed the rule that henceforth mental age must be determined rather than chronological age, as set forth in the statutes of Illinois, in suchcases," Judge Roberts said. 10 Years Is Trial Age "Chronological age for trial in criminal matters is fixed by statute at 10 years," he continued. "We can no longer rest upon ths behavior clinic reports nor the findings of psychiatrists prior to trial, but must have formal proof of the defendant's mental age established in the record. "The court further holds that in Questionable cases of young offenders it would be better for juries to determine the matter than for the court to act upon a plea of guilty and the findings.

This requirement precludes ar.y lawyer from entering a plea: of guilty in such cases henceforth, thus substituting his judgment for the defendant's, or for a court to make a determination of mental capacity in the absence of a jury." Stabbed With Knife Lang confessed to slaying Fellick by stabbing him with a knife and crushing his chest with a heavy stone on Oct. 18, 1947. In his opinion sentencing Lang to 22 years in the penitentiary, Judge Roberts called Lang "a braggart, a small time bully, and a liar," and laid the blame for his delinquency directly on his mother, Mrs. Alma Lang, 52, and the boy's unsavory home life. "The case at bar evidences an abhorrent, gruesome, hideous murder which, if committed by an adult, would merit the 'extreme penalty of the law," the opinion said.

Will Be Tried Again The state's attorney's office, after the Supreme court reversal, said that Lang will be tried again. In the first trial, the prosecution did not ask the death penalty. No indication has been given that the state will demand the death penalty at the second trial. The high court ruling probably will have an effect on the trial of Raymond Polenik, 19, of 3923 S. Grove Stickney, for the slaying of Patrolman Jerry Lebloch of Stickney on Jan.
