The United States Court' of Appeals yesterday cracked down on what it termed the "widespread and ever increasing" abuse of the writ of habeas corpus by criminals who use it as a device to blacken the reputations of reputable officials while trying to seek their freedom from state Institutions.

The court's opinion was given in sustaining Judge John P. Barnes of federal District court, who denied a writ for two convicted murderers, John Rooney, 52, and Henry P. Berry, Rooney and Berry, former union officials, were sentenced to. life 1 imprisonment in 1933 for the slay-, ing of a guard at the Goldblattj Brothers department store, 1609, Chicago av. Now Catchall For Charges as a sacred remedy, to protect the liberty of the citi-i zen," said the opinion, written by Chief Justice J.

Earl Major, "it1 (the writ) has deteriorated to the; point where it now serves chiefly i as a means by which those confined in prison are enabled to make any charge, however heinous it may be, against those responsiv ble for their conviction. "And the regrettable fact is that the courts, particularly federal courts, must in the main share responsibility for this unsavory situation. Until recently when the filing of such writs dropped to about 12 a week more than 100 were being filed weekly in the federal District court here. The practice increased when Judge Barnes began devoting more time to hearing these cases, called in state and county officials to criticize them for not allowing prisoners un trammeled access to such legal maneuvers, and asked the Chicago Bar association, in some cases, to provide free-legal talent for prisoners. No Proof Of Connivance In this case Rooney and Berry presented an affidavit from tha state's star witness.

Alex Davidson, who recanted his trial testimony. The prisoners charged that Davidson committed perjury with, the knowledge and connivance of Malachi J. Coghlan, then an assistant state's attorney, who prosecuted the killers. The appellate court called' Davidson a "flophouse bum" with a criminal record. It said that even if Davidson committed perjury, there was no proof he did it with the connivance of Coghlan.

In unjustified cases of this kind, said the court, "such officials (public officials, including judges), both living and dead, often with enviable records of honorable public service, become the targets of every character of charges capable of "conception by the febrile mind of a person in prison who has no responsibility and nothing to lose."
