will file -with the United States Supreme court Jn Washington, D. today a petition asking: lor Teview of the Circuit Court of Appeals decision which declared constitutional the seizure of Ward properties in Chicago and six ether cities on Dec. 28, 1944. Notice of the appeal and copies of the petition were handed United States District Atty. Woll here yes terday afternoon.

Second Appeal to Court Ward attorneys said a Supreme court ruling: on the war time pow rs of the President will be sought regardless of the return of the properties from army control, a step ordered by President Truman on Aug. 25, but not yet carried out by the war department. Government attorneys sought a Supreme court review last March after Federal District Judge Philip L. Sullivan had ruled the late President Roosevelt exceeded his constitutional authority and war time powers In issuing the directive under which the army took over the Ward properties. The Supreme court refused to act until after a decision by the Circuit Court of The appellate court, by a two-to-one decision, reversed Judge Sullivan.

Deny Act Applied to VFard'a The Ward petition described the ruling of the appeals court as "fantastic." Ward attorneys contended the seized properties do not come within the meaning of the war labor disputes act as "plants mines, or facilities equipped for the manufacture, production or mining of any articles or materials which may be required for the war effort or which may be useful in connection therewith," because they are engaged solely in the retail sale of merchandise for civilian purposes. U. OF C. COSMIC RAY BALLOONS HEAD OVER LAKE A cluster of 67 balloons was released yesterday from Stagg field of the University of Chicago in connection with the university's scientific study of cosmic rays. The balloons, tied together with nylon rope, carried cosmic ray detection apparatus weighing 150 pounds.

They were released at 6:15 a. m. by Serge A. Koroff, director of physics research at New York university, in cooperation with the physics department of the Chicago school. Three previous attempts to start the flight were balked by bad weather.

The balloon cluster rose rapidly, drifted over the loop, then moved rortheast over the lake. Coast guardsmen kept watch to retrieve it in case it fell into the lake. It was expected the balloons would float about 10 hours before bursting in the stratosphere, and that the apparatus would float down somewhere in Michigan.
