official documents which the secre tary alleged Gibson removed from his office files in violation of federal stat tites at the time of his discharge as government attorney for the Islands Gibson was removed from office in the fail of 1933 by Ickes after the attor ney had quarreled with Gov. Paul Pearson of the islands. Lists Documents Missing." In a letter to Gibson, Secretary Ickes listed nine orignals and copies of official letters he wants returned, He cited the federal criminal statutes which make removal of such docu rnents from official files subject to a fine not exceeding $2,000 and impris onment of not more than three years for each document. The secretary added that the return of the docu ments would not relieve Gibson from prosecution for their removal. Gibson testified yesterday that Gov, Pearson had exceeded bis authority tinder the law, was unpopular with a large section of the population of the inlands, and was not frank in his ad ministration.

To support his testi mony Gibson introduced several of the letters now sought by Ickes. Cites Use of Documents. "At the hearing before the senate committee to investigate the adminis tration of the Virgin Islands you pro duced from your custody certain original letters and original copies of let ters written to and by you in your capacity as government attorney of the Virgin Islands on official business of the United States and the govern merit of the Virgin Islands," Ickes wrote Gibson. The removal by you of these offl cial documents was in violation of sec tion3 128 or 129 of the criminal code U. S.

code, title T8. section 234, 235 and Is punishable with respect to each document by a fine of not more than $2,000 or Imprisonment of not more than three years, or both. "1 hereby make demand upon you to return immediately the documents enumerated as well as such other official letters, documents of record which you may have removed from the files." Ickes sent a copy of the letter to Senator Millard K. Tydings chairman of the committee. He assured Tydings that the documents would be photostated by the department of.

C. GARY DIES AT 77; FOUNDER OF PEOPLES HOSPITAL Dr. I. Clark Gary, founder of the People's hospital, 255 West 22d street, and a practicing: physician In Chicago for the last forty-six years, died yesterday in the hospital after an illness of several weeks. He was 77 years old.

POLICEMAN QUITS HOSPITAL AFTER LOSS OF HIS LEGS Without his legs but with his cheerfulness undiminished, Herbert Eckel, a policeman formerly assigned to the Wabash avenue station, left the Woodlawn hospital yesterday after six and a half months and was able to spend the holiday with the family of his sister, Mrs. Henry Schmitt, 7403 May street. Eckel was not embittered even by the news that he must pay his own hospital expenses, though his injuries came as part of his work.

This is in accordance with a law passed in 1928. He will, however, probably receive a pension, police officials said. Eckel was injured last Dec. 10. He had gone with a patrol wagon to take a colored woman to the county hospital.

The vehicle stalled in a snowdrift in front of 6139 South Michigan avenue and while Eckel was helping extricate it another car skidded against him, crushing him against the police vehicle. The United States senate held one of its shortest sessions on record today 15 seconds, and the Republicans had a majority for the first time since March 3, 1933. Three Republicans and two Democrats were present The Republicans, Frederick Steiwer of Oregon, Hiram W. Johnson of California, and Peter Norbeck of South Dakota, taunted Senator Joseph T. Robinson, the Democratic leader, with threats of moving to adjourn sine die, but he boasted that he had "enough men in reserve to keep the Republicans from putting anything over on me." No business could have been transacted anyway, without unanimous consent, for there was no quorum, and Robinson could have killed such a motion by calling a quorum. The senate went through the formality of meeting today because leaders wanted to recess until Monday and the constitution prohibits one bouse, without consent of the other, from adjourning for more than three days.

Vice President Garner called the ses-Kinn tn order at noon, and Senator Robinson asked unanimous consent for the President of the senate to sign the legislative appropriation bill.
