Cilella, 54, a Circuit court judge since 1958, collapsed yesterday while playing golf at the Butterfield Country club south of Lombard, and died a few minutes after arrival at Hinsdale sanitarium and hospital.

Mrs. Messner was a native of Chicago and a graduate of the University of Chicago. She came to New York and opened a bookshop and did editorial work for a firm of which Julian Messner was an officer. They were married and, in 1933, founded the publishing firm bearing their name. When they were divorced in -1944, Mrs.

Messner remained, an officer of the company and when Messner died in 1948 she became presi dent. The firm published Grace Metalious' "Peyton one of the most successful best sellers of recent years, after" her manuscript had been rejected by five other publishers and Mrs. Messner had helped transform it to the style that reached the public. APPEALS COURT BACKS WILSON IN POLICE SUIT Reverses Decision Captains Won The Appellate court yesterday a major feature of Police Supt. Orlando W.

Wilson's reorganization of the city police force. The ruling reversed a decision Feb. 18, 1963, by Judge Charles S. Dougherty in Circuit court. He had ruled 'that Wilson's designation of police district commanders, at higher pay than captains, and his assignment of captains to work under them as watch commanders, was illegal.

Dougherty held that lieutenants should be watch commanders. Averts Many Changes Had Dougherty's ruling been upheld, Wilson presumably would have been required to replace 63 captains serving as watch commanders with lieutenants and to find other assignments for them. The 21 district commanders are paid $14,328 a year, compared with $8,364 to $10,200 a year for captains. Each district commander has three watch commanders working under him, with each in charge of one police shift. All told, the department has 124 men with civil service rank of captain.

The Appelate justices ruled that assignment of police cap- tains as watch commanders is a matter of discretion by the police superintendent. They termed assignments in a police department as "a difficult area in which to justify court interference." Clarify Their Views The justices wrote that the superintendent's actions "should not be subject to review by the courts, except to determine whether, there was or was not good faith and a reasonable exercise of discretion." The office of Michael F. Ryan, attorney for the captains who brought the suit, said he would petition for a rehearing. JACOB SINGER, FORMER RABBI, DIES AT AGE 81 Dr. Jacob Singer, 81, of 5700 Sheridan died yesterday in Mount Sinai hospital.

He was rabbi emeritus of Temple Miz-pah at 1615 Morse which he had served since 1923. Dr. Singer obtained his mas ter's degree from the Univer sity of Cincinnati in 1908, and after his ordination in 1909, took post-graduate work at Johns Hopkins university. He obtained his doctorate at the University of 'Nebraska, and later was a member of the faculty. He lectured oh Jewish liturgical music at Northwestern university.

Judge Cilella ing personal injury cases in the court's law division. For two and a half 'years before that assignment, he had presided in Family court. Judge Cilella received his law degree from Northwestern university after graduating from McKinley High school and Crane Junior college. While in college, he achieved a reputation as a baseball player, and while still in school, had a try-out with the New York Giants. Served in Legislature He was admitted to the bar in 1935, and was elected to the lower house of the Illinois legislature in 1943.

He was Democratic committeeman of the 36th ward until bis election as alderman from the ward in 1951. He was reelected in 1955, and served in the city council until his election to the Circuit bench in June of 1958. Judge Cilella was a member of the executive board of the Chicago Council of the Boy Scouts of America from 1955 to 1961, and' in 1958 received the Boy Scout silver beaver award for distinguished service. Backer of Fluoridation He was made chairman ef the Chicago Youth commission in 1954. As a member of the city coun cil, he led the fight for fluorida tion of the city's water supply.

In June of 1961, he was made a knight officer in the Order of Merit of the Italian republic. Besides his son, Judge Cilella leaves his widow, Mabel, and a daughter, Linda Mary.
