Then he anti another person filed an original bill for the same purpose, and lastly he filed petition in the United States Circuit Court for a review o4 the order of the District Court, showing an evident intentidin to push Yesterday moreing the bankruptcy matter involving the same question at tn.

It was claimed in behalf of Hodgkins that be was the highest bidder, and the proper purchaser under the terms of the vernsemeet for the sale of the property; that be stated to the Assignee that one C. 4 S. Crane wait interested with bun in the purchase, and that an arrange-meat was made by which the sale was to be closed up Monday, July 11 It was also alleged that on the morning of that day Hodgkins and Crane visited tee office of Bradford Hancock before 12 o'clock, and offered to pay 120,000 of the purchase price, but that the Assignee informed tbem that they were too late; tied that be bad just before made a sale to Conro Corkins. In suppoit of this position Hodgkins and Crane filed tbeir own affidavits and also those of W.

Miller, G. W. Cranes and D. These latter affidavits were to the effect that Crane watt a re-, sponsible tarty, and that the affiants had beard Hancock state that be was satistled with him, and also that they supposed he sale was made to Crane, Hodgkins nil being on tbe other side it was clawed by Conro A Corkies that Hsucock had made stplication to Hodgkins several times for payment, but that the latter refused to pay, and that on inquiry it was found that Hodgkins, the actual bidder. was irresponsible.

The affidavit of Bradford train; cock was filed, in which be stated that he did not know at tbe time Maas Crane was the principal Oast. In a conversatioo had eith him, Crane bad talked of the matter in such a way se to lead one to suppoee that it was an optional matter with him wnether be so-, cepted the sale or not that he Inquired of several persons, but could not find that Hodgkins was responsible. Crane, in which the latter stated that be controlled the bid, and would sell it for a consideration that be would accept or reject it, as a purchaser The case was argued for about an hour, and Judge Drummond decided the motion by entering the following order On hearing Cooper and Mr. Crane for the petitioners, sod lir. Tenney for the defendants, the Court is of the opinion that the District Court should not have made an order on the 14h day of July Laot vacating and setting aside the order of said Court made on the Oth day of the same month confirming the bid and sale made to Jefferson Hodgkins by the Assignee, without giving the maid Hodgkins an opportainty to be heard on the same, or ktr. Crane, the party repre. 'Denten as the principal, and for whom Hodgkins WISNI agent.

And the District Court in dirwted to open or eel aside the said order made on the 12th of July, and to give the said Hodgkin or the said Crane an opportunity to be heard upon the application of the Allingnee to wide or vacate the camlumatory. order the Uth of July aforesaid. And it is ordered that in the meantime and until the action of the District Court thereon, all parties to these proceedings do nothing in relation to the property of the bankrupt' prejudicial to the rights of the said Hodgkins fw of the said Crane. Palmer to complete the cbain of his title, or that he gained his kuowledge of thedetect tit Hitt'', title through-the examination of an abstract for -Lie also denies that either. be or his partner was employed to give an opinion on the title of the land alleged in the bill, or that Palmer ever conveyed to 'Wilson as stated in the abstract. Whiteside that his partner received a deed from Palmer of his title, but states knowledge of Palmer's claim was derived from Horatio Hill. the latter stating that Palmer had asked him to looe up bin titles. Hill cut the matter in the bands of Whiteside Bush, and they found on insulination that Palmer bad never conveyed his title, but that the Scliool Fund bad an advance They shortly afterward learned from Palmer himself that Hitt had written him a letter iteking for a quit-claim deed in favor of one Merril Ladd. wbo, it was alleged, owned the land. promising to give e50 for it.
