limestone quarries which have been in operation for many yean and have penetrated deeply into the rock Through the cat thui made and into the qoarries a branch track hu been laid from' the Lackawanna road for the haoUng of the hewn stone Night work being necesury a large part of tha time an are light hu been placed high over the track of the darkest part of the cat Several can wen loaded with stone for shipment Friday and left on the switch pending the observance of Memorial day Tonight preparation for drawing tha cars oat the electric light wu pat in and an engine with the necessary crew left the city for the quarries What wu the sorpriu of all hands upon Teaching the scene of operations to find the track 'beneath the electric light completely thronged with strange insects of great size some of them lying perfectly till in bunches and some of them playing a sort of leap-frog game They covered 1 a space of not leu than sixty feet along the tracks though toward either boundary of the occupied territory they grew fewer the rays of the 'light began to grow dimmer Then pickets or skirmishers were one and all of a most lively disposition and ran over the ground with that lightning-like rapidity which characterized the movements of the electric light bugs that made their appearance all over the country soon after the system of electric lighting became of general adoption incities The locomotive con tinned on its way and the drivers rolled' over the Insects tne -insects died with a crackling sound like the successive explosions of toy torpedoes But this wu at the beginning of the swarm the iron monster plowed its way along tha bugs became more numerous and the crackling grew to a monotonous din as though soma recracker storehouse had been touched off in a hundred places until in the thick of the swarm the engine wu brought to a stop the drivers refusing to catch on the now slippery rails greased by the crushed and slaughtered bugs An examination of the insects showed a resemblanoe to the electric-light bug though they are somewhat larger tun those bugs the outer shell of the back being about the size and shape of half a shanghai-egg shell It wu this turtle- :7 Ell and Col'i Wu It Told and Illegal Choate Contends That It Wa a Samatooa June 5 A large attendance wu present today in the Second Division of the High Court of Appeals to listen to the arguments in the contest ovtr the Tildaa trnst Mr Joseph Choate resumed his argument for the respondents and held the attention of the court until nearly 1 The points made by him were that the charitable plan attempted by tha will is void for indefiniteneae and uncertainty in respect to both the object and the subject mat ter In abort it is dear he says that the thirty fifth article a whole sets forth one entire and inseparable charitable schema which the testator inseparable charitable schema which the testator tiu reputedly strled his general trust and to ab- to subdivide it simply to do violence to the instrument itself and to make anew will for the testator second the trnst attempted to bo cruted by the thirty-ninth article to apply the residuary estate to tha objects and pu (poses thirty-flfth article to roiuM by the hsi of New York because of the absence of beneficiary defined bythe testator entitled to en- force its execution These decisions strike the kiynotOk The question is Was the will valid or Invalid nt the time of the death of the testator The existence of valid trnst capable of enforcement by court of equity to essential to enable one claiming to hold as trustee to withhold the property from legal representatives of an alleged donor The existence of na intent that the hairs end next of kin ho old take nothing beyond specific gifts to of no consequence But the advocates of the will apparently despairing of maintaining the trust which the testator so contrived and faahuxied as not to bo subject to the enforcement of a eonrt of equity fall back bars notion that ti sustained as a power in warrant few such claim The charter of the Tilden trnst doea not conform to the will It to not the corporation contrived and intended by the testator Therefore even though the will should be declared valid this defendant corporation cannot take title to the property in (toed the conveyance actually made by the trustees bee conveyed nothing to it for it ouly purports to convey such property Mr Choate concluded his argument by calling the court's attention to tha fact that the judgment be affirmed and the trnst created declared void end should be adjudged that the defendant the Tilden trnst to nut entitled to take os beneficiary and that the trustees be permanently enjoined from delivering to it any part of the residuary estate James Garter of counsel for the appellants then began hie argument by calling attention to the object at the unit which he said waa to attack soma testamentary provision of the will of the late Samuel Tilden and to procure Judgment declaring it invalid The contested provision that providing for the establishment and maintenance of the free library and reading-room in the City of New York was in the form of bequest of the whole residua of the testa tors estate after satisfying prior legacies etc or so much ns his executors end trustees might diem expedient to corporation thereafter to lie chartered by the Legislature under the name of The Tilden The action which waa brought therefore was made suitable to teat the question whether this provision wee legally valid and whether tha corporation thus chartered was such a one as that described by the testator and therefore competent to take the residue The completeness of Mr Tilden schema he said to ctonriy manifest in the circumstances that little doubt or difficulty has arisen in taking the i necessary to carry it out then i i refemd to tne argument of the ease at special term before Justice Lew Carter I his decision in which he held that the bequest for this purpose wu simple intelligible and valid and tho corporation created by the Legislature wu compelled to take end did take the property conveyed to it It would be rather contrary to the usual experience if so large a gift to a public object that made by Gov Tilden should bo allowed to pass unchallenged however nnsobatantial the grounds of objection to it might seem Much hu been said in the courts below by the learned counsel opposing the gift of the Tilden tract to ths effect that id gifts for the purpose of charity It to necessary that there should be such certainty both as to the subject given and thou who are to take it that a court may enforce or execute it by judicial decree Our courts have held that a gift for the purpose of charity most conform with all the coo-ditiooa which are requisite to give validity to a private gift bat some explanation may be used to how why this certainty is necessary and the way in which it to practicable to obtain it in cases of gifts of charity The speaker argued that ths Andrew Green John Bigelow and George Smith who wen present in the courtroom were known and reputable gentlemen hence the transferees an 'known ana the bequest to valid on that ground and all the courts can do is to see that a succession of proper trustees to maintained The possibilities that the trustees might exercise their power todefeat the trust to too remote and not well founded upon nay eoastrnetiaa of the thirty-fifth clause fur it contains all the elements of alternative disposition He denied that ths question of the validity of the gift is debatable and argued that tha circumstance of discretion con-' fernd on the trustees to wholly without effect on the validity of the gift Popping Qaostion Can yon cookf ho asked tenderly after he
