Lorimer's backers plan to force vote on plea of res adJudicata. Pagel. Senate rejects Sherwood dollar a dal pension bill; adopts McCumber Page IL. BY JOHN CALLAN O'LAUGHLIN. Washington, D.

March SpeciaLl A long and bitter fight in the United Staten sense is certain to result from the divided report which the Lorimer inveetigating committee will Oubmit. It is the purpose of Lorimer's friehds to do everytbing in their power to have the senate vote upon a technicality. They realize there ts grave. danger to the eitting senator itthe senate should be forced to vote upon a resolution declaring he procured his election through bribery and corruption and that he Is not entitled toohls seat To get around this cbjection it is proposed to force a vote upon.the plea. of re adjudicates.

This plea is regarded as ridiculous by the most eminent lawyers In the senate. They say the time for this plea to have been offered as a bar to further proceedings was last June, when the senate unanimously passed the resolution creating's special committee to make a thorough investigation of the charges against Mr. Lorimer. Committee Not Limited. The committee was not limited to the discovery of new evidence, though it gathered a mass of it.

but was directed to make the most comprehensive investigation possible ht eompliarrees with the overwhelming sentiment of the American people. Some of the members of the senate at that time expected Mr. Lorimer's friends to raise the plea of res adjudicata and investigated this proposition. They came to the conclusion that there was no basis for such a plea. Mr.

Lorimer'e friends, hoes-ever did not oppose this bar to the investigation. The commettee went ahead and examined the witnesses who appeared before the trst investigating committee as well as a large number of witnesses who theretofore had not testified. It held sessions on 102 days both in Washington and Chicago, employed counsel, expert accountants, and other assistants, and put the government to an expense which will aggregate at least $100,000. Now It is proposed to cast aside all the work done and to have the senate vote that We case was closed before it was ever reopened. Leading- Lawyer's Opinion.

One of the foremost lawyers of the senate today made this statement In regard to the Proposed plea: "Theplea of res adjudicata, if viewed In a technical legal sense, Is one that any court can of its own motion enter at any stage of line Proceedings before it If this plea can be invoked In any proceedings before the elate, then, of course, the senate of Its Own motion could enter It at any stage of the i proceedings.
