Ashland to RAILWAY, CREWS FREED IN WRECK TAKING 45 LIVES Series of Acts Blamed in Burlington Crash The Du Page county grand jury, after five months of 'hearings, yesterday declined to take action against the Burlington railroad and the crews of two fast trains involved in the April 25 wreck at Na-perville which took 45 lives, but blamed the wreck on a series of unconnected negligent acts by both the railroad and the crews. No single negligent act of omission or commission caused the wreck, the gTand jury reported to the Du Page county Circuit court. The grand jury voted a no bill against W. W. Blaine, 68, of Gales-burg.

Six of the dead were company employes and the other was a volunteer fireman. All died from burns. Huge clouds of smoke, lighted by tongues of flames, swirled into the air as the fire swept unchecked for almost four hours after the first of a series of blasts shook the 13 million dollar aviation gasoline refinery last night. J. Howard Pew, president of the company, said damage to equipment was about $300,000 and operations of the refinery as a whole of the Seattle Post-Intelligencer.

Two Photografers Assaulted A few minutes after the verdict two photografers were assaulted by a state highway patrolman and a court officer outside the courtroom. Gunter said Court Officer Burl Dooley pushed him down a flight of stairs. Ray said State Highway Patrolman Arnold Davis smashed his camera. Smashes His Camera Gunter said the court officer told him he wasn't supposed to enter the courtroom, and then smashed his camera and "took me by the collar and shoved me downstairs." Ray said he started to take a picture of the scuffle when Davis knocked his camera out of his hands.

No Single Act to Blame "The grand jury considered that the several separate and distinct acts committed singly could not have produced the tragic result, and that therefore in the absence of any supporting proof, there is Insufficient evidence to justify return of an indictment against any one person or group," the report said. Safety recommendations by the jury included scheduling departures of fast trains on the same tracks with the proper margin of safety in running times; brake tests on all trains before their departures; making up of passenger trains with cars of equal equipment and strength; all passenger trains to be equipped with radar or automatic train controls; safety block signals be spaced so as to protect high speed trains; installation of Mars oscillating signal lights on the rear of all passenger trains to be in constant use when the trains are running; flagman to be required to ride in the rear car and to be furnished with more modern warning signals, and the installation of two-way radios in all passenger trains. Blaine Story Not Heard The grand jury never heard Blaine's story of the wreck, it was reported, because he previously had been charged with manslaughter on a coroner's jury recommendation, and it was believed that he would refuse to testify before the grand jury on the ground that he was already charged with a crime and so could not be forced to tell his story. Blaine's attorney, Edward Streit of Aurora, said that Blaine is now in his Galesburg home recuperating from Injuries suffered in the accident. He was discharged from an Aurora hospital June 2L but has not returned to work.
