DIGS CRUDE grave, Waits 4 days to die Berkeley, April 7 (if) The fantastic story of a man who dug a crude grave in a cellar and lay. in it for four days awaiting death came to light today.

The moaning cries of Joaquin R. Rios, 24, an unemployed Puerto Rican, finally attracted the attention of his roommate in an apartment house. Rios was rushed to Highland hospital in Oakland. Incoherent and still in stupor, he did not tell what prompted his near-fatal act. He was found yesterday by Michael J.

Cremin, his roommate, who traced the faint cries of "Michael, Michael." The grave was about 5 feet long, 3 feet wide, and 2 feet deep. There were no evidences of food and he evidently had not eaten since Monday. Cremin said Rios had been depressed over the death of his 96 year old grandmother. The federal tax was set at $1,164,748, and the state tax $906,309 in the estimate filea with Edward J. Barrett, clerk of County court. 97,000 Motorola Shares The estate consists mainly of 97,403 shares of Motorola stock, which was doubled at a stock split aftef Calvin's death on Nov. 5, 1959, at the age of 64. When an estimate was filed last year, attorneys said the estate was worth about 15 million dollars, but because of distributions and other factors, including esti mates of what large blocs of stock would bring, it was revalued at the 13 million dollar figure.

Included in the estate was $109,000 in insurance, in cash, $80,100 worth of bonds, and $163,000 in notes due. There were also some other small stock holdings. Galvin made bequests of nearly 2 million dollars to nine relatives, and left half to his widow, Virginia, of 3038 Normandy Evanston, and the other half with the Harris Trust and Savings bank in trust for charitable purposes. R. GAIT HER, CRITIC OF U. S. DEFENSE, DIES Boston, April 7 UP) H. Rowan Gaither 51, author of the controversial Gaither report which was critical of United States defense preparedness died today in Massachusetts General hospital.

Gaither, a lawyer, also a former presi dent of the Ford Foundation, had been a patient of the Lahey clinic and, doctors said, was aware for some time that he had cancer. Gaither, a Natchez. native, was assistant director of the Massachusetts Institute of Technology's radiation laboratory in World War II. Karl Compton, then M. I.

T. president, recommended Gaither to the Ford Foundation and Gaither became head of that organization's committee on policy and program. He had been chairman of the board of Rand corporation, leading research organization and had been a consultant of the national defense research commission. His much discussed report on defense was at the request of former President Eisenhower. TRIAL FRIDAY FOR SEVEN IN TAVERN BRAWL Seven men arrested in a brawl in a west side tavern after Thursday night's Chi cago Stadium hockey game were charged yesterday with assault battery, resisting arrest, and disorderly conduct.
