Powell WASHINGTON U.S. District Judge George L. Hart who ruled against the late Rep. Adam Clayton Powell in his fight against being barred from Congress, died Monday in George Washington University Hospital. He was 78.

The judge's family said the cause of death was a heart ailment. Judge Hart was appointed to the federal bench by President Dwight Eisenhower Aug. 26, 1958. He served as chief U.S. district judge here from March 19, 1974, to July 14, 1975, and achieved senior status on May 16, 1979.

Judge Hart gained national attention in the case involving Powell, a Harlem Democrat who sought court support in his unsuccessful attempt to overrule a House decision in January, 1967, refusing to let him take his seat because of financial irregularities and travel abuses. Powell was re-elected to the House two years later and seated after he agreed to surrender all seniority and pay a $25,000 fine. Powell, who spent much of that term at an island retreat in the Bahamas, was defeated in the 1970 Democratic primary. He died in 1972. IN HIS DECISION, which went against Powell, Judge Hart cited the Judge George Hart in 1967 constitutional doctrine of separation.

of powers, which he traced to the Babylonians 2,000 years before Christ, and the 18th English concept of a strong, independent judiciary. Born in Roanoke, Judge Hart. was graduated from Virginia Military Institute in 1927 and obtained a law degree three years later from Harvard University.
